By accessing or using any services provided by [Your Studio Name] ("we," "us," or "our"), including attending classes, workshops, private sessions, or using our website and scheduling systems, you (the "Participant" or "Client") agree to these legally binding Terms of Service and all applicable laws, including those in the State of California.
2. Services Provided
We offer:
Group fitness classes (Pilates, Strength training, Cardio, Stretch)
Special workshops, events, and wellness sessions
Online and recorded content (when applicable)
We reserve the right to change class formats, instructors, availability, pricing, and other services at our sole discretion without notice.
3. Eligibility & Participant Responsibilities
To participate, you must:
Be at least 18 years old or have a parent/guardian’s written consent if under 18
Be in good health and cleared by your physician for physical activity
Notify us of any medical conditions, injuries, pregnancy, or concerns
Follow instructor guidance and studio safety policies at all times
Pregnant individuals and those with health concerns must consult their physician before attending and inform the instructor in writing. We reserve the right to restrict participation for safety.
4. Attire, Safety & Hygiene
Grip socks are required for all in-studio sessions
Proper workout attire must be worn
Personal hygiene and cleanliness are expected for the health and comfort of all
Failure to meet attire and hygiene standards may result in refusal of participation.
5. Assumption of Risk & Waiver of Liability
IMPORTANT: BY PARTICIPATING, YOU WAIVE CERTAIN LEGAL RIGHTS.
You understand that physical exercise involves inherent risks, including serious injury, illness, or death. By participating in our services, you:
Voluntarily assume all known and unknown risks
Release SESH Studio, its owners, staff, agents, and affiliates from liability for any injury, damage, or loss arising out of participation
Acknowledge this waiver includes negligence (except gross negligence or intentional misconduct per California Civil Code § 1668)
6. Memberships, Payment, and Billing
All classes, memberships, and sessions must be prepaid
Memberships auto-renew unless canceled in writing at least 7 days prior to renewal
Billing begins varies on the packages, memberships and classes purchased
7. Cancellations, No-Shows & Refunds
Class cancellations must be made at least 12 hours in advance
Late cancellations incur a $15 fee
No-shows incur a $20 fee
Refunds are not issued for used services or expired sessions. Medical or emergency-based exceptions may be considered with documentation.
8. Studio Conduct Policy
To promote safety and respect, participants agree to:
Arrive on time and check in before class
Refrain from disruptive, threatening, or unsafe behavior
Respect instructors, staff, and fellow clients
We may suspend or terminate participation for any conduct violations without refund.
9. Medical Emergencies
In the event of a medical emergency, we will:
Call emergency services (911) when necessary
Notify your provided emergency contact
You accept responsibility for any costs incurred as a result.
10. Intellectual Property
All class content, branding, training material, and recorded media are the intellectual property of SESH Studio and may not be copied, distributed, or reused without written permission.
11. Privacy & Data Protection (CCPA Compliance)
We collect and store data to manage your account, schedule classes, and provide services. In accordance with the California Consumer Privacy Act (CCPA), you have the right to:
Access, update, or delete your data
Request that your information not be sold or shared
Receive a copy of the personal information we store
We never sell personal data and use third-party systems securely.
12. Force Majeure
We are not responsible for delays or cancellations due to events beyond our control, including natural disasters, public health emergencies, or power outages.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Diego County, California. Prior to litigation, parties agree to attempt resolution through informal discussion or mediation.
14. Changes to Terms
We may update these Terms at any time. The most current version will be available in-studio or on our website. Continued use after updates constitutes acceptance.
15. Acknowledgment
By purchasing, booking, or participating in any of our services, you acknowledge that you have read, understood, and voluntarily agree to these Terms of Service.
